Man calls 911 taco bell, A Largo man was arrested early Wednesday on charges he called 911 because Taco Bell refused to sell him food at the drive-through window because he wasn't in a car.

Terry Kimbell, 50, was charged with misuse of the 911 system, a misdemeanor. He was released shortly after his arrival at the Pinellas County Jail.

Late Tuesday night, Kimbell got through to the Largo Police Department, and said he didn't use his car to drive to a Taco Bell at 13709 Walsingham Road because he had been drinking, so he walked up to the drive-through window.

It is Taco Bell's policy that no one be sold food at the drive-through window unless they are in a car.

"They wouldn't serve me," Kimbell told a dispatcher. "I just want some tacos. That's it."

"Okay and why are you calling 911?" the dispatcher answered.

"I'm being discriminated against," Kimbell said, according to a copy of the 911 call.

"You called 911 because you want tacos?" the dispatcher replied.

Kimbell acknowledged he was told by a store employee he couldn't be served unless he was in a car; but he told the dispatcher that if he drove his car, he would risk getting arrested on a drunken-driving charge. And he didn't want to run that risk.

"You got to get a DUI to get a taco," Kimbell said. "That's basically what they're saying."

"I refuse to get a DUI," he said. He also told the dispatcher he got a case of the "munchies" and the Taco Bell happened to be open.

Kimbell told the dispatcher he was an ex-Marine, and he likened himself to Rambo. He later said he was a student at Stetson University.

A dispatcher told Kimbell he was sending a police officer.

Kimbell offered to buy the officer a doughnut. But the dispatcher told him he was sure the officer was not going to want one.

Instead, the officer arrested him.
